Terms of Service

GENERAL

Terms are subject to updates at any time, and if payment is not yet given commissioners are held responsible to knowing the most up-to-date Terms at the time of their payment. For protection of my time and effort, no artwork is started until AFTER payment is given. Completed and fully paid artwork grants fhe commissioner personal right to use the artwork. All art made by Ropoca Pao Illustration is still held with the intent that I will post on social media and store it with full use. At any time I reserve the right to refuse a commission for any reason. NEVER will any art be allowed for use for AI generative tools or NFTs.

PAYMENT - CANCELING - REFUNDING

All payment for a commission must be paid in full, upfront. The currency accepted is USD. There will not be a payment plan unless discussed otherwise. When a Commission is canceled by a commissioner, there is a 100% refund of the amount paid by the client if work was not started. When a client pays in full, work on the art begins immediately if there is not a queue. For any commission that is cancelled after it was begun I retain 25% of the amount paid for time compensation. If a client cancels their commission, all work done by me is not given to the client to use and they hold no claim over anything produced. Any remaining artwork produced for a canceled commission can be freely used, altered, or sold by me.

DURING A COMMISION

Work In Progress (WIP) content will be given primarily at the commissioner's request. WIP content may be given without asking if I require feedback. Any deadlines given by me are NOT final or exact, and are only estimates to the completion of the commission. I reserve the right to maintain estimated times of completion, but also note that they are subject to change due to:Health, Order of Commissions, Complexity, Natural Disasters and Other Emergencies, and Work, School, or Family issues. I am not obligated to notify my clients of personal emergencies in detail, and can freely elect to cancel a Service at any time due to any of the previously listed reasons, with 100% refund of the commission price.

CHARGE BACKS

At the completion of a product, the client receives no product if the payment is charged back. The client who charges-back a completed commission has no right to demand for artwork after payment was received and the commission was started and/or finished. If the client has committed such misconduct, the client will be placed on a private blacklist that will prevent their commission requests from being accepted by me. Blacklisted clients retain the right to any past art that was fully paid; but for any unpaid, charged-back, or unfinished commission the client no longer holds right to use. No blacklisted client has the right to demand a refund under any circumstances after payment are received, even if the commission was canceled by means mentioned in section DURING A COMMISSION or section PAYMENT - CANCELING - REFUNDING.

DESIGNS AND CUSTOMS

Any art made by Ropoca Pao Illustration will require credit to the artist. Reposting without providing direct links, removing watermarks entirely from publicly viewed images, or deleting original artwork belonging to a custom design are all forbidden.Owners of art or designs made by Ropoca Pao Illustration cannot be sold for more than what was paid by the commissioner.Free, Non-currency Trades, and unofficial Digital Currency payments exchanged for the artwork result in the inherent value of the design or artwork being $0. Artwork purchased with those means cannot be sold for real currency.Performing any of the above violations will result in the current owner of the artwork becoming blacklisted. Those with rights to the artwork can:Create a separate image of modified artwork as long as the original is retained and both are credited properly, Alter the design of a custom character freely as long as the original artwork is not deleted, Create "doppelganger" or "twin" designs to the original made by Ropoca Pao Illustration, Create alternate forms based on the original design artwork.

CUSTOMER SATISFACTION

After a commission is paid in full, all effort is made to satisfy the directions of my client. After a product is finished, there is a limited amount of extra alteration or work that can be done. Small mistakes that the commissioner isn't happy with can be fixed for no charge. However, any re-drawing or large altering will be charged with an additional fee. If the feedback given to the client says that minor mistakes will be likely due to the reference material, small alterations will be given an extra charge, due to the client being aware of the likely result and still agreeing to purchase a commission. I am not responsible for dissatisfaction with results if the client did not provide a clear definition either visually or in writing of what they wanted before paying in full.

COMMERCIAL RIGHTS

A Purchase of Commercial rights to artwork from Ropoca Pao Illustration will be 100% upcharge of the normal price. With commercial rights you are allowed to make any sort of product with the artwork EXCEPT for use in AI or NFT materials. Credit is still required for usage of the artwork, even if altered or edited. Art that is purchased with the intent of commercial use from me must be discussed BEFORE full payment, otherwise it will be considered a violation of TOS.Commercial Rights CANNOT be purchased after the original commission has been completed and fully paid.

If the commissioner breaches the terms any way listed below, every right the client had to the art produced will be retracted and right to use the art is revoked.
